“Burned-by-price-scanner” isn’t this ridiculous?
Who: County Judge Ernest DeSantis Jr., Dominica Juliano (12), Juliano’s grandmother
What: Grandma claimed the girl was burned and traumatized when a convenience store clerk supposedly aimed a hand held scanner at her face. She also claimed the girl was sensitive to light, burned and developed psychological problems as a result. Judge Ernest threw away the lawsuit.
When: Wednesday April 14, 2010
Where: Erie, Pennsylvania. Store is un-specified
Why: The clerk called the girl “grumpy” before flashing her in the face and telling her to smile. Grandma became angry with the situation and decided to file a lawsuit trying to sue the clerk.
How: Clerk shinnied the scanner in Dominica’s face, assumable that grandma became angry, therefore she filed a lawsuit to sue the clerk.
Opinion:
Laser pointers that can be sold in the US do not cause retina burn/damage. Nor do LED lights in a scanner. Her retinas were not burned, which is probably why the judge threw the lawsuit away. If they had medical evidence of a burn it would have gone forward in the courts. This grandma should have just let this one slide, now she has to pay up court fees and the legal fees the store might have incurred.
