bought a fake item on ebay? refund?

i bought an item on ebay to find out it was fake. when i asked the seller for a refund he insisted that they were real but i know they dont because they do not look like the real ones and he also stated they were in good condition and when i got them the shoes were creased in. he says that he did not state that they were real but he is telling me they are. but can i get a refund even though he is unwilling?

** the size tag date does not touch the barcode which indicates that the shoes are fake.

    Yes, file a claim with eBay and PayPal immediately, saying the item was fake. If eBay and PayPal find that the item was indeed fake, then they will refund the money regardless of what the seller thinks.
