is it ok to sue when…?

ok so here’s the story. i sent my phone in to get repaired in sept. and got it back and they found nothing wrong and then i sent it in again in november because after you send it in for the same thing twice they usually have to replace it, so i got it back yesterday and they wont replace it because of physical damage….it wasn’t there when i sent it in. I need a new phone and they wont replace it. its hard to explain but sometimes the screen goes to a multi-colored barcode…thats what it looks like and then on the back of it, by the charger place it has 4 scratches that look like when they tried to remove the back with a tool it got scratched and i know i didnt do it. WHat DO I DO????? i dont have the money for a new phone

    send it back again, and again, and again…

    also call them, and talk to a manager and explain
    ask the person who answers to talk to a manager,
    and sometimes if you get a MAN (with an intimidating
    voice to explain, or who is one of those guys who always
    wins an argument) to talk to them , maybe that will help too.

    good luck. but complain, complain complain, and
    also put it i n writing… write letters, that helps too, document
    what has been going on. (fax and mail, and e mail your letters in)

    hopefully this will get you some results.
    keep them clean and proper no cursing in them.

    you can sue them but i whould talk to an attorney first

    first off, you would need proof that the phone wasn’t scratched when you sent it in. Talking to an attorney would cost more than the phone is worth, call them up. Tell them all you want is your phone fixed.
