Who has to to chose a Barcode for a product? The manufacturer or the retailer?
Additionally can you trademark your barcode? What is the procedure in choosing one? Sorry but I have no clue on how bar code system works.

    The basic answer to your question is that while anyone in the retail chain (manufacturer, exporter, importer, distributor, or retailer) can theoretically take responsibility for barcoding a product, it generally falls to the manufacturer/developer of a product to obtain their UPC or EAN barcode for their product.

    If your product is destined for the United States or Canada then you should obtain a UPC code (12-digits). Read more about those here: upccode.net/upc-guide/upc-code.html

    Everywhere else in the world, retailers use the 13-digit EAN barcode system. Read about EAN codes here: upccode.net/upc-guide/ean.html

    I do not believe that barcodes can be trademarked. But that’s a question for your legal team. Generally, since retail barcodes are based on official UPC or EAN numbers that you obtain in your name, you can defend any misuse pretty effectively without a trademark.
